Terms and Conditions.

​These Terms and Conditions are the standard terms for the provision of services by Empower Retreats. These Terms and Conditions contain important information concerning participation by you and members of your party in Our Services and accordingly, you acknowledge and agree that you shall ensure that you and all members of your party are aware of, understand and accept these Terms and Conditions. Upon purchasing services from Empower Retreats such as paying a deposit or in full for a retreat, you are accepting the Terms and Conditions set out below.

​1. Medical & Health

  • All clients attending Empower Retreats should be aware that when participating in any exercise or exercise programme, there is the possibility of physical injury. In making a booking, you agree to assume such risk and agree to release and discharge Empower Retreats from any and all claims for liability, injury, loss and/or damage arising out of your participation in our services.

  • You are required to notify us ahead of booking if you have any medical conditions that make you unsuitable to participate or impact your participation in our services.

  • Unless otherwise disclosed in writing to Empower Retreats ahead, you confirm you are in good mental and physical health and are unaware of any reason why you may be particularly unsuited to taking part in the activity and/or service agreed upon or may be likely to suffer illness or injury during the activity and/or service.

  • You are required to fill out a medical form ahead of attending a retreat flagging any personal health issues.

  • All clients are advised to consult with their GP / doctor before beginning any exercise programme.

  • Failure to disclose any serious illness, injury, or other medical or health reason enables Empower Retreats to reserve the right to refuse the client to partake in our services and could result in Empower Retreats terminating your contract and canceling the booking without any refund.

 

​2. Insurance

  • We strongly recommend that you have travel insurance with comprehensive personal accident and cancellation insurance in case of injury or inability to complete the duration of your stay that covers Our Terms and Conditions, particularly those regarding amendment or cancellation charges and that such insurance is purchased at the time of your booking.

 

​3. Booking Conditions

  • These Terms and Conditions govern the sale and provision of services by Empower Retreats and will form the basis of the contract between us and you. Before submitting a Booking, please ensure that you have read these Terms and Conditions carefully.

  • If you are unsure about any part of these Terms and Conditions, please ask Us for clarification.

  • To place a booking Empower Retreats requires a completed booking form with payment of the entire fee.

  • Booking terms and conditions are accepted by the client upon the point of booking.

  • Nothing provided by us including, but not limited to, sales and marketing literature, price lists and other documents constitutes a contractual offer capable of acceptance. Your booking constitutes a contractual offer that we may, at our discretion, accept.

  • A legally binding contract between us and you will only be created upon the receipt by us of cleared funds of the entire fee, and our acceptance of your booking which is indicated by the issuing of our booking confirmation. Booking confirmations will be provided in writing.

  • Empower Retreats reserves the right to decline any booking at their discretion.

  • To book a place on an Empower Retreat, you have to arrive on day one of the retreat within the time window specified unless otherwise agreed ahead.

​4. Fee and Payment Terms

  • The entire fee is payable in full at the time of booking and before the commencement of the retreat unless agreed otherwise ahead.

  • We accept the following methods of payment: Bank Transfer, Visa Credit and Debit Cards, Mastercard Credit and Debit Card

  • If you wish to make a payment via Bank Transfer rather than through our website, please contact us to make arrangements.

5. Client Alterations

  • A booking name can be changed and the booking passed over to a different client to attend the retreat, only if full payment has been received and changes are made in excess of 4 weeks before the booking arrival date. This will incur an admin fee of £120 to cover associated costs due to the personalised nature of our retreats.

 

​6. Cancellation by Empower Retreats

  •  We try our best not to cancel a confirmed booking but reserve the right to do so.

  • If we cancel a confirmed booking before your retreat start date, Empower retreats will provide a full refund or offer the Client another available date (with pro-rata refund/price increases as appropriate).

  • Force Majeure (events outside of our control): Empower Retreats cannot accept liability or pay any compensation (including the refund of any monies) where the ability to perform our obligations under our contract with you is prevented or affected by or you otherwise suffer any damage, loss or expense of any nature, as a result of “force majeure”. In these booking terms and conditions, “force majeure” is defined as any unavoidable and/or extraordinary circumstances beyond our control for which we (or our third-party service providers) could not have avoided, even if all reasonable measures had been taken. This may include, whether actual or threatened, such events as war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions (flood, storms, earthquakes etc), epidemics, pandemics, fire, explosion, power failure, and other situations which are outside our control. Clients are advised to take out adequate travel insurance to cover such eventualities.

  • If any event is likely to adversely affect or prevent our retreat from happening, we will inform you as soon as is reasonably possible.

​7. Cancellation by the Client

  • If the client wishes to cancel the contract they must advise Empower Retreats in writing.

  • Clients who don’t show up for the retreat forfeit the full cost.

  • If the client cancels less than 12 weeks before the start date of the retreat, the cancellation charge will be 100% of the payable fee.

  • If the client cancels more than 12 weeks before the start date of the retreat, the cancellation charge will be 50% of the payable fee.

​8. Responsibilities of the Client

  • Clients shall be held responsible to make compensation for any damage they cause to the contents and furnishings of the premises during their stay, except for wear and tear.

  • Empower Retreats accepts no responsibility for the loss, damage, or theft of personal possessions, which includes, but is not limited to, clothing passed to third party cleaners, clothing, jewellery or similar items of value, personal equipment, or the like, used at the retreat. Clients are advised to ensure that they are adequately insured against these events.

  • It is the responsibility of the client to arrange travel to the site/location for the proposed activity and or service unless otherwise stated.

  • The client is also responsible for their own personal medical requirements and personal footwear equipment and clothing unless otherwise stated.

​9. Retreat Etiquette and Dress Code

  • Empower Retreats asks that clients wear appropriate gym attire at all times during training sessions including sports shoes and fitness clothing.

  • Empower Retreats asks all clients to dress appropriately being mindful and respectful of all cultures, races, and religions whilst on the retreat.

  • Empower Retreats reserves the right to speak to clients about their attire and dress at any point during their stay should they be causing offence to other guests or contravening camp etiquette.

  • Clients must refrain from any illegal act or any conduct which may give offence or cause danger or damage to any person. If we or any of our staff, consultants and/or agents become aware of any such action, we may at our absolute discretion have you immediately removed from any property or facility and such conduct by you will comprise a material breach of these Terms and Conditions and without prejudice to any other right or remedy to which we may be entitled, such material breach will entitle us to cancel our contract with you immediately and you will not be provided with a refund of the fee that you have paid to us.

  • Excepting reasonable wear and tear, you shall be held responsible and liable to compensate us for any damage you cause to any of our premises, facilities and/or property during your participation in a retreat.

​10. Alterations by Empower Retreats

  •  We make every effort to ensure the accuracy of our literature. However changes can occur despite our best endeavours and we reserve the right to change any price or other particulars before the client books (in which case we will tell you before your booking becomes binding).

  • If there is a ‘Major Change’ to a confirmed booking we will inform you as soon as is reasonably practical and shall offer you the choice of accepting the change, receiving a full refund or transferring to another available date. Should there be any change to the fee caused through the provision of alternative arrangements, we will notify you of this at this time also.

  • If there is any change other than a ‘Major Change’ we are not obliged to inform you in advance (but we will do so where practicable), required to make alternative arrangements nor are we obliged to offer any refund or pay you compensation. If we become unable to provide a major proportion of the services you have booked we will make every effort to arrange alternative arrangements for you at no extra charge and where appropriate refund the client pro rata for services not received.

​11. Conditions of Service

As part of the continual review of safety and associated considerations the conditions of booking are subject to change clarification and modification at any time.

  • Empower Retreats reserves the right to alter the content of the services at any time without notice to the client due to certain factors including but not limited to the weather and physical fitness of the client.

  • The programmes we publish in our literature and on our website and describing the retreats are designed to be illustrative in order to best explain the scope and type of activities you will be undertaking. At any time and dependent on certain factors including but not limited to the weather and your physical fitness, we reserve the right to change the content of the services where required without notice to you. It is very unlikely that any one retreat could be or would be followed precisely as it is published. Several factors outside of our control will determine this and dictate what can be accomplished reasonably during your stay. The most influential factors will be the weather and the physical fitness, needs and preferences of retreat participants.

  • Our retreat leaders, guides and instructors will do their utmost to ensure that any problems are solved for the benefit of the course participants as a whole. Signing the booking form signifies your acceptance of the retreat leaders authority to make decisions affecting the group or individuals.

 

​12. Acceptance of Authority

  •  Empower Retreat leaders and staff, including third-party contractors, will use their best endeavours to resolve problems to the benefit of the client as a whole.

  • The client must refrain from any conduct which may give offence or cause danger or damage to any person or property.

  • The retreat leader may require an individual or number of persons to leave the group if they believe that the client’s health and safety are at risk if an illegal act has been committed or the client has behaved in a way as to endanger safety enjoyment or the welfare of the group as a whole. In the event of this action the client involved shall not be entitled to any refund and will be required to meet all expenses involved in their immediate extraction.

 

13. Complaints​

  • If there is a problem during the activity and or service period you must report it in the first instance to the retreat leader. If it is still unresolved you must then report it immediately so that prompt and effective efforts can be made to resolve the problem.

  • In the unlikely event that the problem cannot be resolved at this time and you wish to raise a complaint full written details must be sent to Empower Retreats within 28 days of the activity and or service finishing. Please include your booking reference number / party details and exact full details of your complaint on your letter; please include your daytime and evening contact telephone numbers. Failure to take these steps will prejudice our ability to resolve your problem and/or investigate it fully therefore any right to compensation you may otherwise have had will be lost or substantially reduced.

 

14. Media​

  • Empower Retreats reserve the right to take any photographs or video recordings of the client during the activity and /or services and the client accepts that all rights whatsoever arising in the media or footage shall by solely owned by Empower Retreats.

  • The client accepts and agrees that any photographs or video recordings may be used by Empower Retreats at its absolute discretion in any manner including but not limited to its website, socials media, marketing, PR, promotional material and advertisements.

  • If a client has any issues with any of this footage being used, they must notify Empower Retreats in advance of the retreat start date.

 

15. Law and Jurisdiction

  • These Terms and Conditions, the Contract, and the relationship between you and Empower Retreats (whether contractual or otherwise) shall be governed by, and construed in accordance with the law of England & Wales.
